What PA Gun Trader Is

PA Gun Trader provides an online listings platform that connects private sellers and licensed FFL dealers with prospective buyers. PA Gun Trader does not sell, purchase, or transfer firearms, ammunition, or accessories. PA Gun Trader is not a party to transactions arranged between users. Transactions involving listed items occur directly between buyers and sellers and independently of PA Gun Trader.

PA Gun Trader does not:

  • take title to listed firearms or other items;
  • take possession or custody of listed firearms or other items;
  • receive or process the purchase price for listed firearms;
  • hold firearm transaction funds in escrow;
  • ship or deliver firearms;
  • conduct firearm background checks;
  • perform legally required firearm transfers;
  • determine whether a user is legally eligible to purchase, receive, transfer, own, or possess a firearm; or
  • guarantee that any user, listing, firearm, or transaction complies with applicable law.

PA Gun Trader receives subscription fees for access to platform services. Those subscription fees are not commissions, firearm purchase payments, transaction fees, or compensation for arranging or completing any particular firearm sale or transfer.

Your Responsibility

Buyers and sellers are solely responsible for complying with all federal, state, and local laws applicable to their activities and transactions, including laws governing the sale, purchase, transfer, shipment, receipt, ownership, and possession of firearms and related items. Depending upon the transaction, applicable requirements may include background checks; transfers through federally licensed firearms dealers; Pennsylvania transfer procedures; age restrictions; residency requirements; restrictions applicable to particular firearms or other items; federal requirements governing interstate transactions; and other federal, state, or local requirements.

The fact that a firearm or other item is advertised through PA Gun Trader does not make an otherwise unlawful transaction lawful and does not exempt any user from an applicable legal requirement. PA Gun Trader does not provide transaction-specific legal advice and does not determine which laws apply to an individual user's proposed transaction.

Account & Platform Verification

Creating or maintaining a PA Gun Trader account does not establish that a user is legally eligible to purchase, receive, sell, transfer, own, or possess a firearm. Any identity verification, seller verification, FFL-related information, account status, membership status, user review, reputation information, or other trust-and-safety feature provided through PA Gun Trader is a platform feature only.

PA Gun Trader does not conduct a firearm background check through account registration or platform verification, and users must not rely upon account or verification status as proof that another user is legally eligible to participate in a firearm transaction. Any background check legally required for a firearm transaction must be completed through the legally authorized process.

FFL Transfers

Where federal, Pennsylvania, or other applicable law requires a firearm transaction to be completed through a federally licensed firearms dealer ("FFL"), sheriff, law-enforcement agency, or other authorized person or process, users must complete the legally required procedure before the buyer takes possession of the firearm. Both buyers and sellers are responsible for determining and satisfying the legal requirements applicable to their transaction.

PA Gun Trader does not select an FFL for the parties, perform the legally required transfer, conduct the associated background check, or determine whether a particular transaction qualifies for an exception from an otherwise applicable transfer requirement. If an FFL is involved in a transaction, users are responsible for independently communicating with that FFL and satisfying the FFL's lawful procedures and requirements.

Pennsylvania Firearm Transfers

Pennsylvania law imposes specific requirements on certain firearm sales and transfers, including certain transactions involving persons who are not licensed firearms dealers. Depending upon the firearm, parties, and circumstances, Pennsylvania law may require a transaction to be completed through a licensed dealer, county sheriff, or other legally authorized procedure.

Users should not assume that a transaction is exempt from Pennsylvania transfer requirements merely because both parties are private individuals or because the transaction originated from a PA Gun Trader listing. Pennsylvania law also contains statutory exceptions applicable in particular circumstances. PA Gun Trader does not determine whether a particular transaction qualifies for an exception. Users are responsible for determining and following the Pennsylvania requirements applicable to their particular transaction before transferring possession.

Background Checks & PICS

Pennsylvania uses the Pennsylvania Instant Check System ("PICS") in connection with background checks for firearm transactions where applicable. PICS functions associated with firearm transfers are performed through legally authorized persons or entities, including authorized firearms dealers, sheriffs, and other authorized law-enforcement personnel, as applicable.

PA Gun Trader does not operate PICS, conduct PICS checks, approve firearm purchasers through PICS, or receive authority through PICS to determine whether a user may lawfully receive a firearm. Any PA Gun Trader account, identity, membership, seller, or other verification feature is separate from the legally required background-check process.

Interstate Transactions

Firearm transactions involving residents of different states may be subject to additional federal and state requirements. Users should not assume that a transaction that may be lawful between Pennsylvania residents may be completed in the same manner when the buyer and seller reside in different states. Where applicable law requires an interstate firearm transaction to involve an FFL or other legally authorized procedure, the parties must complete that process before the buyer takes possession.

Users are also responsible for determining whether the firearm may lawfully be transferred to and possessed by the recipient under the laws applicable to the transaction. PA Gun Trader does not determine whether a proposed interstate transaction is lawful or whether a particular transfer procedure satisfies federal or state law.

Prohibited Persons

Users may not knowingly sell, transfer, provide, purchase, receive, or facilitate the transfer of a firearm in violation of applicable law. PA Gun Trader may not be used to facilitate a firearm transaction for or on behalf of a person legally prohibited from receiving or possessing the firearm. Users may not use PA Gun Trader to evade or circumvent laws concerning prohibited persons, background checks, licensed-dealer transfers, age requirements, residency requirements, or other firearm restrictions. If applicable law requires a background check or other legally authorized determination of eligibility, that process must be completed before possession is transferred.

No Straw Purchases or Circumvention

PA Gun Trader may not be used to arrange or facilitate an unlawful straw purchase or other transaction intended to conceal the identity of the actual purchaser or recipient or to circumvent an applicable firearm law. Users may not: misrepresent the identity of the actual purchaser or recipient; provide materially false information concerning a firearm transaction; use another person to evade a legal restriction; structure a transaction to avoid a legally required background check or transfer procedure; or otherwise use the platform to facilitate an unlawful firearm transaction.

Suspected violations may result in listing removal, account restriction, suspension, termination, and, where legally permitted or required, referral to appropriate authorities.

Prohibited Listings

Listings for firearms, weapons, accessories, or other items that cannot lawfully be offered, sold, transferred, shipped, received, or possessed under applicable federal, state, or local law are prohibited. Users may not post: unlawful firearms or other prohibited items; materially false, fraudulent, deceptive, or misleading listings; items the seller does not lawfully possess or have authority to offer; listings intended to circumvent a background check or transfer requirement; listings associated with unlawful straw purchases or prohibited-person transactions; or listings otherwise prohibited by the PA Gun Trader Terms of Service or platform policies.

PA Gun Trader may review reported or suspected violations and may remove or restrict listings, limit account functionality, warn users, or suspend or terminate accounts when PA Gun Trader reasonably believes that a listing or user violates applicable law, the Terms of Service, or platform policies, or creates material legal, regulatory, fraud, security, or safety risk. PA Gun Trader's decision not to remove a listing does not constitute a determination or representation that the listing, item, seller, buyer, or proposed transaction is lawful.

Transaction Payments

PA Gun Trader does not receive, hold, transmit, or process the purchase price paid by a buyer to a seller for a firearm or other listed item. Any subscription payment made to PA Gun Trader is payment solely for access to platform services and is separate from any transaction between users. Users should not send firearm purchase funds to PA Gun Trader or represent that PA Gun Trader is holding or processing funds on behalf of a buyer or seller. Buyers and sellers remain responsible for independently arranging any lawful payment associated with their transaction.

Shipping & Delivery

PA Gun Trader does not take possession of, package, ship, transport, or deliver firearms or other listed items. Buyers and sellers are responsible for determining whether shipment or delivery is lawful and for complying with all federal, state, carrier, FFL, and other requirements applicable to shipment, receipt, and transfer. The availability of communication or listing functionality through PA Gun Trader does not constitute authorization or approval of any particular shipping or delivery arrangement.

Platform Enforcement & Reporting

PA Gun Trader may investigate reports or suspected violations of its Terms of Service, this Compliance Notice, platform policies, or applicable law. PA Gun Trader may, as appropriate: remove or restrict listings; restrict platform functionality; request additional information; warn users; suspend or terminate accounts; preserve relevant account or listing information; or take other reasonable measures to protect the platform, its users, or third parties.

PA Gun Trader may preserve or disclose information when legally required or when reasonably appropriate to respond to valid legal process, investigate suspected unlawful activity, protect users or third parties, or enforce its Terms of Service. PA Gun Trader is not required to independently investigate or verify every user, listing, report, or transaction.
